A DITCH on a Melbourne bike path was a "hidden trap" that directly
contributed to the death of a cyclist, a coroner has found.
Robert Graham, 55, broke his neck and subsequently died after hitting
a culvert and being flung over the handlebars of his bicycle on a
popular bike track in Melbourne's north on February 27, 2007.
The impact severed his spinal chord and paralysed him from the neck down.
He died on March 2 last year after agreeing to have his life support
at the Austin Hospital switched off.
Coroner Dyson Hore-Lacy today found that the culvert was a "classic,
hidden trap" and that the local Nillumbik Shire Council had a duty of
care to maintain the bike path.
The culvert "caused Mr Graham's fall and contributed to his death," Mr
Hore-Lacy said in his finding.
Mr Hore-Lacy delivered two key recommendations in his finding.
He called on the Victorian government to consider providing extra
funding to local councils to allow them to maintain and develop safe
shared pathways.
He also recommended the government undertake a review of Australian
standards and guidelines relevant to Victoria for shared pathways.

This infrastructure is under the care of control of SA Water and/or its contractors United Water.

There are many faults in the road surface in the Celtic Ave bike lane
heading East from Bradley to South roads.
Some faults are uneven service covers, some are dips in bitumen, and
some areas have bitumen missing.
There are at least 6 hazards in this section that exceed 20mm in
depth. Where the bitumen is missing the edge is 90degrees.
I did not have time to photograph and record each fault as I had an
appointment to meet.

The attached hazard has been phoned through to Trans Adelaide (next to
railway line), United Water (Sewer SIP).
Please attend to the hazardous stormwater drain as appropriate.
This area was previously stated as "...not a council issue". Please
reconfirm this if this is the case.
Please note that this road is part of the BikeWay path for cyclists.

Hello There is a dangerous drain cover on the Esplanade just South of Gilbert Street. The gap between the bars of the grate are big enough for a bicycle wheel to fall into the grate up to the axle. This hazard has been recorded on the Road Repair wikispace - This street is not suitable for cyclists. - The hazard will cause damage to bicycles - There is a high risk of injury to the cyclist from impact and possible fall. - There is a high risk of injury or death from being stuck by a car while negotiating the road. Please advise me of your action to rectify this problem. |
